The act of 68/2018 which amends the act of 171/1993 Z.z. on the Police force as amended is in force from 25.05.2018.

As part of the amendment to the said Act, new provisions were inserted as follows:

§69h par 3 Passenger name record (hereinafter referred to as “PNR”) pertains to the information and personal data of a passenger, which are collected by an air carrier during the performance of their activities for the purpose of processing of booking, its subsequent control, which is stored in booking systems, departure control systems or other equivalent systems which provide such functions in commercial air transport.

§69i par 1 An air carrier shall be obliged to provide the PIU SK with the PNR of each flight heading from outside the EU. If requested by the PIU SK, an air carrier shall be obliged to provide the PIU SK with the PNR also for the flight within the EU; the list of flights within the EU shall be published in the Official Journal.

§69i par 6 A PNR shall be transferred with such data that an air carrier has at its disposal at that particular time, however not exceeding the data as set out under Annex No 4

§69i par 7 A PNR shall be transmitted by one of the possible formats of data via the supported protocol set out under a specific regulation. An air carrier shall be obliged to notify the PIU SK of a common protocol and format of the data to provide the PNR.

§69i par 8 If a technical fault occurs in communication with the Passenger Information System, an air carrier shall be obliged to forthwith transmit such data via other appropriate way while maintaining the same level of security as when transmitting a PNR that is pursuant to paragraph 7.

§69o par 1 The PIU SK may impose a fine up to EUR 20.000 upon an air career, which fails to provide a PNR in accordance with Article 69i.

It follows that a fine of up to EUR 20 000 may be imposed if:

1. the air carrier does not provide PNR data available at the time (§69i paragraph 3 of the Act), or

2. the air carrier does not notify the PIU SK of the protocol and data format by which the PNR will be transmitted.

 

If the air carrier does not have any automatic technical solution for collection and transmission of PNR data nor any other subject or provider, air carrier can send PNR data via secured web portal manually. Provider of web portal is Ministry of Interior of the Slovak republic.
