Are you a non-EU citizen and have an employment contract with a company based outside the EU? Can you be transferred to the position of manager, specialist or trainee to a branch of this company based in an EU Member State? Below you will find information on the conditions to be met, the procedures to be followed and the rights you can exercise during your stay.

MODE 1: Conditions 

If you want to come to Slovakia as an "ICT" worker, you must apply to the relevant embassy of the Slovak Republic for a temporary residence permit for the purpose of ICT employment.

If you are in the position of a senior employee or an expert, a temporary stay for the purpose of ICT employment will be granted for a maximum period of three years. If you are in the position of an intern, a temporary stay for the purpose of ICT employment will be granted for a maximum period of one year.

 To meet the conditions for the transfer of an ICT employee, you must have an employment contract in a company based outside the EU and be transferred as a manager, expert or intern to a branch of this company based in the Slovak Republic. You can submit an application for a temporary residence permit for the purpose of ICT employment only at the embassy of the Slovak Republic accredited for the state of which you are a citizen or in which you reside. The application cannot be submitted on the territory of the Slovak Republic. The number of citizens from outside the EU who can work and live in Slovakia is not limited by a quota.

MODE 2: Procedures

Where and how to apply

In general, you can apply for a temporary residence permit for the purpose of ICT employment at a Slovak embassy accredited for the state of which you are a citizen or in which you reside. The embassy will not accept the application if, when submitting it, it finds out that you will be staying for a longer period in the territory of another EU Member State than in the territory of the Slovak Republic during the temporary stay.

Obligations of the employer

No later than 20 working days before submitting an application for temporary residence for the purpose of ICT employment, the branch of your employer based in the territory of the Slovak Republic must notify the vacancy to the relevant office of labor, social affairs and family.

In order to obtain ICT, you must submit the following documents to the relevant embassy of the Slovak Republic:

1. Completed and signed official application form,

2. valid travel document and two color photos,

3. employment contract,

4. confirmation of the duration of ICT in the place of the company with its registered office in the territory of the Slovak Republic,

5. confirmation that you are entering the position of a senior employee, expert or intern in a company based in the Slovak Republic,

6. confirmation of the amount of remuneration, other conditions of employment that will apply during ICT,

7. confirmation that after the end of ICT you will be able to return to the same company based outside the EU,

8. confirmation that the company based in the Slovak Republic belongs to a company based outside the EU that sends you on ICT,

9. confirmation that:,

  • you were employed in a company based outside the EU before the date of ICT, to which the company based in the territory of the Slovak Republic belongs for at least six months if it is a position of a manager or expert, or at least three monthsf it is a position of an intern,
  • you have the professional qualifications and experience to perform as a manager or a professional,
  • you have a university degree required for the performance of a job, a training agreement for the purposes of professional growth or the acquisition of knowledge in the field of business management in the case of an intern,
  • you meet the conditions for the exercise of a regulated profession, if it is a regulated permit,

10. extract from the criminal record of the state of which you are a citizen and of the state in which you have resided for more than 90 days in the last three years,

11. proof of your accommodation in the Slovak Republic,

12. administrative fee 170 EUR. 

All documents issued by official bodies abroad must be translated into Slovak by an official translator and must be duly certified (apostille or higher legalization of documents). The submitted accommodation documents and criminal record should not be older than 90 days on the day of application. It is possible to submit documents issued or verified by official authorities of the Czech Republic in the Czech language.

Refusal of ICT

Temporary residence may be refused in the following circumstances:

a) you are an unwanted person,

b) there is a reasonable suspicion that during your stay you will endanger the security of the state, public order or public health,

c)  you do not meet the conditions for granting temporary residence,

e)  you provide false or misleading information or present false or altered documents or another person's document,

f)  your details in the travel document do not correspond to reality,

g)  granting temporary residence is not in the public interest,

h)  it is obvious that your accommodation in the territory of the Slovak Republic does not meet the minimum requirements according to a special regulation,

i)   the office of labor, social affairs and family will issue a certificate containing disagreement with the filling of the vacancy,

l) if:

      1. the company for which you are to perform ICT was established with the main purpose of facilitating the entry of employees within ICT, or

      2. you have already exhausted the maximum length of stay set for ICT,

o) the standpoint of the security services of the Slovak Republic contains disagreement with the granting of temporary residence.

Other requirements

If you are subject to the visa requirement, you will also need an entry visa issued at an embassy of the Slovak Republic accredited for the state of which you are a citizen or in which you reside after granting a temporary residence for the purpose of ICT employment.

Duration of ICT validity

If you are in the position of a senior employee or an expert, a temporary stay for the purpose of ICT employment will be granted for a maximum period of three years. If you are in the position of an intern, a temporary stay for the purpose of ICT employment will be granted for a maximum period of one year.

MODE 3: Rights

Family members can also apply for a temporary permit to stay in the Slovak Republic in order to come with you or join you. The relevant Foreigners Police Department will grant your family members a temporary residence permit for the duration of your temporary residence for the purpose of your ICT employment.

You can use the mobility of an ICT employee between EU Member States if this mobility will be applied from the territory of the Slovak Republic to another Member State and will be performed by the same employer or the same group of employers. In this case, the other EU Member State will not require you to have a temporary stay in its territory. The conditions of mobility from the territory of the Slovak Republic to the territory of another EU member state are governed by the legal regulations of the EU member state where the mobility applies.
